Ardutch (the Netherlands) Finds a Way Out of Invalidation Disputes

A Russian company initiated invalidation actions against Ardutch’s Arctic trademarks:

• a non-use cancellation suit against the international registration No 808857 was filed to the Intellectual Property Court; and
• invalidation requests based on the similarity of the trademark registration No 812798 and the international registration No 808857 to the claimant’s product name were submitted to Rospatent’s Chamber for Patent Disputes.

Sojuzpatent attorneys negotiated a peaceful solution and facilitated the signing of the respective documents. As a result, the plaintiff dropped their claims at both Rospatent and the IP Court. The client’s rights have been fully preserved.

Ardutch B.V. is a part of Arçelik Group, a major producer of household appliances, particularly refrigerators and washing machines, including those marked by the Arctic designation.
