Is it possible to extend a Eurasian patent (obtain a supplementary protection certificate)?
Pursuant to the Eurasian Patent Convention, the term of a Eurasian patent is 20 years from the filing date of the Eurasian application.
Although the term “supplementary protection certificate” is not officially used, the applicable regulation provides for a possibility to extend the period of validity of a Eurasian patent with regard to specific member states (this is normally permitted in respect of patents related to medicinal/agrotechnical products and pesticides).
Pursuant to Rule 16.5 of the Eurasian Patent Regulation, the period of validity of a Eurasian patent may be extended for each state where an extension is provided for by national legislation.
In 2025, legislation of all contracting states except Turkmenistan contained a provision allowing the patent holders to apply for an extension of their patents (this information can change at any time and you have to check it when needed).
The period of validity of a Eurasian patent for any member state is extended by the Eurasian Office in accordance with the national requirements upon receipt of the corresponding request (an official fee is to be paid).
The information about granted requests is entered in the Register of Eurasian Patents and published in the Gazette of the Eurasian Patent Office.
