My Little Horse Toys Infringe on Hasbro’s My Little Pony Trademark

Sojuzpatent lawyers successfully defended the interests of Hasbro Inc. (USA) in a trademark infringement case related to illegal importation of counterfeit toys.  

A Vladivostok customs post stopped a delivery of children’s toys bearing the designation “My Little Horse.” The toys were imported from China. Sojuzpatent lawyers acting in the interests of Hasbro Inc., the owner of the My Little Pony trademark, filed a request to recognize the infringement and to bring the infringer to administrative liability for importing counterfeits. The customs officers arrested the goods, initiated an administrative case, and filed a lawsuit in the Arbitration Court of the Primorskiy Region.

According to documents submitted to the court on the client’s behalf:

  • the My Little Horse sign used by the defendant, Ellie Ltd., is confusingly similar to Hasbro’s trademark;
  • it is intentionally used so as to create confusion among consumers;
  • the importation of toys marked by the My Little Horse designation causes damages to Hasbro and undermines the public order.

Having considered the case, the court recognized the imported toys as counterfeit, imposed a fine on the defendant, and ordered the goods to be destructed in accordance with the applicable law.
