The IP Court ruled to invalidate the Russian trademark № 551704 «MAMMUT МАММУТ».

Sojuzpatent helped Marussia Beverages B.V. (the Netherlands) to invalidate the Russian trademark № 551704 «MAMMUT МАММУТ» as confusingly similar to Marussia’s previously registered trademarks № 292670 «MAMONT» and № 373940 «МАМОНТ».
The application was initially filed with Rospatent’s Chamber for Patent Disputes, which did not recognize the signs as confusingly similar and rejected the claim. The Chamber’s decision was appealed to the Intellectual Property Court.
The Court reversed Rospatent’s decision and ruled to invalidate the disputed trademarks with regard to all the goods of class 33 and main services of class 35.
