Krasnodar Court Orders Destruction of Counterfeit Goods

A cargo of modelling sets was stopped by the Novorossiysk Customs during a routine check of imported goods. The sets were marked by designations with the following word elements: “my LITTLE horse”, “Play-Toy”, and “Play-Doh”. Sojuzpatent filed a petition in which it stated confusing similarity of said designations to Hasbro Inc.’s Russian trademarks No 88257 (My Little Pony) и No 644850 (Play-Doh).

The customs arrested the goods, opened an administrative case and filed a lawsuit in the Krasnodar Region Arbitration Court. The court agreed with Sojuzpatent’s arguments and recognized the infringement of the client’s trademarks. The importer was brought to administrative liability under part 1 of Article 14.10 of the Russian Administrative Offenses Code and the counterfeit goods - ordered to be confiscated and destroyed.
