An invalidation action against the protection in Russia of the international registration № 1367150 (ST-RÉMY) was filed with Rospatent’s Chamber for Patent Disputes. The plaintiff claimed that ST-RÉMY is a reproduction of the name of the Christian saint Remigius and therefore it cannot be used as a sign marking alcoholic beverages because this offends the religious feelings of believers.
Sojuzpatent lawyers’ position prevailed at the hearings and protection of the trademark was kept in full.
The plaintiff filed an appeal to the Intellectual Property Court, which considered the matter in a hearing on June 5, 2024 and ruled to let stand the RUPTO's decision.
