IP Court Upholds Decision in Favor of Right Radio Broadcasting Station

The Intellectual Property Court upheld an earlier decision of Rospatent’s Chamber for Patent Disputes. By said decision, the Chamber for Patent Disputes had rejected a cancellation action brought against our client’s figurative trademark containing the word element «ПРАВИЛЬНОЕ  РАДИО» (“RIGHT RADIO”) (registration № 568342).

The cancellation request had been filed to Rospatent on the grounds of an alleged lack of distinctive character. The rights owner’s position was represented by Sojuzpatent’s trademark attorneys. This position was sustained by the Chamber for Patent Disputes, which rejected the plaintiff’s claims. The Chamber’s decision was affirmed by the Head of Rospatent on September 20, 2019.

The Right Radio station is broadcasting in the Kuzbass region in Siberia.
