INTUIS & CIE (France) Retains Rights to the NOIROT Trademark

A dispute over early termination of the NOIROT trademark, protected under International Registration No. 986701, ended in a victory for the trademark owner.

The French company INTUIS & CIE, with the assistance of Sojuzpatent’s attorneys, successfully defended its exclusive rights to the NOIROT trademark in the Russian Federation.

At a hearing on February 4, the Intellectual Property Court dismissed NOIROT LLC’s non-use claim. The court’s full written opinion, published on February 18, states that the plaintiff, NOIROT LLC (Russian Federation), abused its rights by bringing the non-use action, in violation of Article 10 of the Russian Civil Code.
