Intellectual Property Court Safeguards Brand Assets of Rational AG (Germany)

Sojuzpatent's legal team has successfully defended the interests of Rational AG, a global leader in professional thermal cooking equipment. The firm fully preserved the client's rights to its "RATIONAL" trademarks under international registrations No. 1337731, No. 520523, No. 886229, and Russian Federation Certificate No. 424925.
The Intellectual Property Court ruled that the plaintiff, a Russian individual entrepreneur, lacked a legitimate interest in challenging the trademarks. Furthermore, the court concluded that the plaintiff's claims for early termination based on non-use constituted an abuse of rights in the context of Article 10 of the Civil Code of the Russian Federation and Article 10 bis of the Paris Convention.
