Last year, Rospatent’s Chamber for Patent Disputes, in its hearing, refused to satisfy an objection against the validity of the patent for industrial design No. 139627 "Nozzle for air humidification systems" owned by Buhler AHS LLC.
The objection was based on the alleged non-compliance of the design with the novelty criterium. The Chamber for Patent Disputes did not agree with the assertion that the sources provided by the claimant fully disclose the essential features of the protected design.
The claimant appealed the decision to the Intellectual Property Court, which heard the case and agreed with the position of Sojuzpatent lawyers. The Court ruled to dismiss the appeal and the client’s patent rights were retained in full.
