A major Russian dairy producer, Foodland, faced a challenge to its key new brand, X-Tra Fit, which features low-fat dairy alternatives and cheese. It was the client’s priority to swiftly obtain a trademark registration; however, another registration was cited against their application by the RUPTO. All attempts to reach out to the trademark owner and settle failed. Thus, Sojuzpatent's lawyers prepared the necessary evidence of legitimate interest, fulfilled pre-trial formalities, and filed a non-use action, bearing in mind the time constraints facing the client’s brand. The Intellectual Property Court deemed the provided evidence satisfactory and decided to grant the claims in full, terminating the cited IR No. 1500611 for similar products in Class 29 of the Nice Classification (Case No. SIP-850/2025).
