Court Satisfies in Full RIXOS Claims in TM Infringement Case

The Tula Region Arbitration Court ruled in favor of Sojuzpatent’s client, the hotel and resort management company Rixos Hospitality B.V. (the Netherlands), in a civil law suit regarding the infringement of a series of trademarks. Our client’s trademarks were illegally used by a hookah café business in central Tula. Based on our professional opinion and the collected evidence, the court ruled to prohibit the use of the opponent’s confusingly similar designation in rendering services of class 43 of the Nice Classification, in offers of relevant services, in advertisements, on signs, on documentation, and on the Internet, including in a domain name, and also awarded RUB 1,200,000 in compensation from the infringer in favor of our client.

Rixos Hotels operates 27 luxury hotels ( 17 of which are operated as waterfront resorts) and holds properties in Azerbaijan, Egypt, Kazakhstan, Russia, Switzerland, Turkey and the UAE. As of 2016, Rixos Hotels was the largest hotel chain in the East Mediterranean Europe region.
