The Saratov Region Arbitration Court ruled in favor of Sojuzpatent’s client, Hasbro Inc. (USA), in an administrative offense case brought against an importer of counterfeit goods after a customs seizure.
Officers at a Saratov customs station discovered toys marked with a designation confusingly similar to the “My Little Pony” trademark owned by Hasbro. The goods had been imported to the territory of the Eurasian Economic Union through the customs border in Kyrgyzstan. They were stopped by a customs mobile task group. After receiving notification from the Saratov customs station, Hasbro Inc. filed a petition to bring the importer to administrative liability for importing infringing goods. Customs initiated an administrative case and filed a lawsuit in the Arbitration Court of Saratov region.
Having considered the case, the court satisfied the claims in full and brought the importer of the counterfeit goods to administrative liability under part 1 of Article 14.10 of the Russian Administrative Offenses Code with a fine of 50,000 RUB and confiscation and destruction of the infringing goods.
