Appellate Court Upholds Ruling Favoring Hasbro

27 January 2026

In Primorsky Krai, following a complaint filed by Sojuzpatent, an importer was held administratively liable under Part 1 of Article 14.10 of the Code of Administrative Offenses of the Russian Federation for attempting to import counterfeit toys bearing markings confusingly similar to Trademark No. 346976, TRANSFORMERS, owned by Hasbro, Inc.

Disagreeing with the decision in Case No. A51-16802/2025, the importer appealed, arguing, among other things, that the trademark at issue was not similar to the markings used on the goods.

After reviewing, among other materials, Sojuzpatent’s written submissions, the Fifth Arbitration Court of Appeal rejected the importer’s appeal and affirmed the first-instance court’s decision as lawful and well-founded.
