Sucampo (Mallinckrodt) Patent Successfully Defended in Court

On April 8, 2019, the Chamber for patent disputes ruled in favor of our client – a patent-holding company Sucampo AG – in a patent invalidation case.

Rospatent's decision was appealed to the Intellectual Property Court. In its hearings held on October 20, 2020, the court rejected the claims, affirming the validity of Sucampo's patent. The Russian patent  № 2275368 is related to lubiprostone, a medication used in the management of chronic idiopathic constipation, predominantly irritable bowel syndrome-associated constipation in women and opioid-induced constipation.

The client was represented by Sojuzpatent attorneys and lawyers in both instances.
