Arbitration Court Rules in Favor of Sojuzpatent’s Client – DAF Trucks N.V. (Netherlands)

The Arbitration Court of the Moscow Region ruled in favor of Sojuzpatent’s client – DAF Trucks N.V.  (Netherlands) in an infringement case with regard to trademark “DAF” under international registration No. 448007. The case was previously considered by Arbitration Court of Moscow Region in the first instance, by the Tenth Arbitration Appeal Court – in the second instance, by the Court on Intellectual Property Rights – in cassation instance. The Court on Intellectual Property Rights canceled the Decision of the Arbitration Court of the Moscow Region and Decision of the Tenth Arbitration Appeal Court and directed the case for a new consideration to the Arbitration Court of the Moscow Region which took a new decision to prohibit the defendants LLC “SIAZ” and LLC “Vector Trans Baltica” to manufacture trucks marked by trademark “DAF” under international registration No. 448007, to withdraw from LLC “Vector Trans Baltica” a compensation for the infringement of trademark rights in the amount of 100000 rubles and expenses for payment of the state fee.
