The Tenth Arbitration Appeal Court ruled in favor of Sojuzpatent’s client – CJSC “CROCUS” (plaintiff) in trademark and company name infringement case. The Court upheld the decision of the Arbitration Court of the Moscow Region in part regarding the obligation of the defendant - JSC "Crocus" to stop using the designation "Crocus" confusingly similar to the plaintiff’s Russian trademark "КРОКУС" No. 345279 and to stop using the full company name Open Joint Stock Company "Crocus" and short company name JSC "Crocus" confusingly similar to the full and short company name of the plaintiff. The Tenth Arbitration Appeal Court changed the decision of the Arbitration Court of Moscow Region in part regarding the amount of compensation for the violation of the plaintiff's exclusive rights for the trademark and decided to recover from JSC "Crocus" compensation in the amount of 300 000 (three hundred thousand) rubles and expenses for the state fee in the amount of 21 000 (twenty one thousand) rubles.
