Court for Intellectual Property Rights Rules in Favor of Sojuzpatent’s Client - Soremartec S.A.

The Court for Intellectual Property Rights ruled in favor of Sojuzpatent’s Client - Soremartec S.A. (Belgium) in an infringement case with regard to the Russian trademark "РАФАЭЛЛО" No. 395732. The court upheld the Ruling of the Fifteenth Appeal Court and the Decision of the Arbitration Court of Rostov Region regarding the same case. The court fully satisfied the claims of Soremartec S.A. and withdrew from JSC "Kagalnitskiy Molokozavod" in favor of Soremartec S.A. compensation for the infringement of the exclusive rights for the Russian trademark No. 395732 in the amount of 12 017 760,00 rubles, and also withdrew from JSC "Kagalnitskiy Molokozavod" in favor of Soremartec S.A. expences for payment of state fee in the amount of 87 880,00  rubles. The court ordered JSC "Kagalnitskiy Molokozavod" to stop manufacture and enter into civil turnover milkshake on the package of which designation "РАФАЭЛЛО" is used.
