Arbitration Court Rules in Favor of Sojuzpatent’s client SOREMARTEC S.A. (Belgium)

On April 4, 2013, The Moscow Arbitration Court ruled in favor of Sojuzpatent’s client – SOREMARTEC S.A. (Belgium) (Plaintiff). The court obliged “AgroPromTorg” LLC (Defendant) to stop the infringement of the intellectual property rights of SOREMARTEC S.A. for the Russian trademark No. 383705 and trademark under the international registration No. 1013255. It also prohibited the Defendant from manufacturing and entering into civil circulation the confectionery for identification of which the said trademarks are used. The court obliged “AgroPromTorg” LLC to withdraw from the civil circulation and destroy, at its own expense, the confectionery “Sweets in white chocolate”, and to destroy the equipment used for manufacturing and packing the confectionery “Sweets in white chocolate”. The Court also recovered from the Defendant in favor of SOREMARTEC S.A. a compensation in the amount of 1 000 000 rubles and 39 000 rubles of the expenses for the state fee.
