Arbitration Court Rules in Favor of Sojuzpatent’s client SOREMARTEC S.A.

On March 6, 2013, The Moscow Arbitration Court ruled in favor of Sojuzpatent’s client – SOREMARTEC S.A. (Belgium) (Plaintiff). The court obliged JSC “Kogalnitskiy molokozavod” (Defendant) to stop the infringement of the intellectual property rights of SOREMARTEC S.A. for the Russian trademark No. 395732 (РАФФАЭЛЛО) and prohibited the Defendant from manufacturing and entering into civil circulation the milk cocktail marked by the designation “Рафаэлло” similar to the trademark “РАФФАЭЛЛО”. The court also recovered from the Defendant in favor of SOREMARTEC S.A. compensation in the amount of 12 017 760 rubles and 87 880 rubles of the expenses for the state fee.
