Arbitration Appeal Court Rules in Favour of Sojuzpatent’s Client OBI GmbH & Co. Deutschland KG

The Ninth Arbitration Appeal Court  ruled in favour of Sojuzpatent’s client - OBI GmbH & Co. Deutschland KG (Germany) (plaintiff) in an infringement case with regard to the trademark «OBI» under the international registration No. 646003. By the said ruling, the court satisfied Sojuzpatent’s claims and discharged the order of the Moscow Arbitration Court  regarding the refusal to take the injunctive measures.  The Ninth Arbitration Appeal Court of Moscow ruled to take the injunctive measures and prohibit the defendant Pivkin D.S. to transfer the administrator’s rights for the domain names OBI-MARKET.RU and OBBI-MARKET.RU to the third parties, and prohibited the registrar of  the said domain names JSC "Regional Network Information Center" (third party) to register the transfer of Mr. Pivkin’s rights for the domain names OBI-MARKET.RU and OBBI-MARKET.RU until the decision on the case enters into force.
