Arbitration Appeal Court Rules in Favour of Sojuzpatent’s Client Soremartec S.A. (Belgium) on Trademark “РАФФАЭЛЛО”

On July 31, 2012, the Tenth Arbitration Appeal Court of Moscow ruled in favour of Sojuzpatent’s client Soremartec S.A. (Belgium) (plaintiff) in a trademark infringement case. By said ruling, the Court affirmed the decision of the Arbitration Court of the Moscow Region, according to which an injunction was put against the use of Russian trademark registrations No. 383705 (designation of a sweet) and No. 395732 (РАФФАЭЛЛО) when selling confectionary "Candies "Rafael". The court also decided to recover in favour of Soremartec S.A. a compensation from one of the defendants, “Eliseevskaya Confectionary Factory” LLC, in the amount of 2 000 000 roubles, and from the other defendant, “Eksprod” LLC, in the amount of 50 000 roubles.
