Arbitration Appeal Court Rules in Favour of Sojuzpatent’s Client "Gedeon Richter"

On May 23, 2012, the Ninth Arbitration Appeal Court of Moscow ruled in favour of Sojuzpatent’s client Open Joint-stock Company "Gedeon Richter" (defendant) in a patent infringement case. By the said ruling, the Court affirmed the decision of the Moscow Arbitration Court, according to which the Court rejected the claims of the plaintiff, Bayer Pharma Aktiengesellschaft, to put an injunction against the importation into the territory of the Russian Federation and the sale by Open Joint-stock Company "Gedeon Richter" of the medicinal product "Midiana" in which, according to the plaintiff’s opinion, the invention "Pharmaceutical combination of ethinylestradiol and drospirenone for use as a contraceptive" under patent RU 2269342 was allegedly used.
