Economic Court of Kiev Rules in Favour of Sojuzpatent’s Client Gedeon Richter NYRT

On May 3, 2012, the Economic Court of Kiev took a decision in favour of Sojuzpatent’s client Gedeon Richter NYRT (Hungary) and its representative office in Ukraine (defendants). By the said decision, the Court rejected the claims of the plaintiff, Les Laboratoires Servier, to prohibit the defendants to use Ukranian patent No. 80087 by way of importation, storage and state registration of medicinal product “Predizin”. By said decision, the Court also satisfied the counter claims of the defendants and recognized the patent of Ukraine No. 80087 “Matrix tablet for extended release of trimetazidine: a method of its production” as invalid in full.
