Volga-Vyatskiy District Arbitration Court rules in favour of Sojuzpatent’s client Soremartec S.A. on Trademark “РАФФАЭЛЛО”

On February 21, 2012, the Federal Arbitration Court of the Volga-Vyatskiy District took a Decision in favour of Sojuzpatent’s client Soremartec S.A. (Belgium) (plaintiff) in a dispute regarding the infringement of the exclusive rights for Russian trademark registration No. 395732. By the said decision, the court affirmed the decision of the Arbitration Court of the Vladimirskiy Region of July 13, 2011 and the decision of the First Arbitration Appeal Court of October 24, 2011 according to which one of the defendants - LLC "RosFront" is obliged to pay to Soremartec S.A. compensation for the infringement of the exclusive rights for the trademark in the amount of 2,000,000 roubles, to stop manufacturing, introducing into the civil circulation and advertising ice-cream the packagings of which is marked with the designation "Рафаэлла", to destroy on  its own expense the existing packagings of ice-cream marked with the designation "Рафаэллa", and the second defendant - LLC "Kormilts" is obliged to pay to Soremartec S.A. a compensation for the infringement of the exclusive rights for the trademark in the amount of 10,000 rubles.
