Arbitration Appeal Court rules in favour of Sojuzpatent’s client Gilmar S.p.A. on Trademark “ICEBERG”

On March 23, 2012, the Fifteenth Arbitration Appeal Court ruled in favour of Sojuzpatent’s client Gilmar S.p.A. (Italy) (plaintiff) and affirmed the Decision of the Arbitration Court of the Rostov Region in the part of recovery from the individual entrepreneur Mokrov I.A. (defendant) 100,000 roubles in favour of Gilmar S.p.A., and in the part of compelling the defendant to stop the violation of the exclusive rights for the Russian trademark registration No. 403157 which consists in selling goods marked with the designation  “ICEBERG” when introducing them into the civil circulation, and offering for sale, in placing the designation “ICEBERG” on the documents connected with the introduction of the goods into the civil circulation, and in placing the designation “ICEBERG” on boards.
