Arbitration Court Rules for Sojuzpatent’s Client Fo Shan Shi Nan Hai Li Feng Ji Xie Corporation

September 8, 2010 the Moscow Arbitration Court took a Decision in favor of Sojuzpatent’s client Fo Shan Shi Nan Hai Li Feng Ji Xie Corporation (China) (Plaintiff) in an infringement case for the trademark under international registration No 936586. By the said Decision it is prohibited for the Defendant to offer for sale and to sell goods, namely, metal-working machines (07 class of ICGS), which are marked by the designation «ACL» confusingly similar to the trademark under international registration No 936586, the Defendant is forbidden to use the designation «ACL»  confusingly similar to the trademark under international registration No 936586 on the documentation connected with the introduction of goods, namely, metal-working machines (07 class of ICGS), into the civil turnover in the territory of the Russian Federation, it was also decided to reimburse from the Defendant in favor of  Fo Shan Shi Nan Hai Li Feng Ji Xie Corporation compensation for the infringement of trademark rights under the international registration No 936586 in the amount of 100 000 rubles.
