Arbitration Court Approves Amicable Agreement in Favor of Sojuzpatent’s Client – FERRERO S.p.A. (Italy)

The Arbitration Court of Pskovskay Region approved an Amicable Agreement in favor of Sojuzpatent’s client – FERRERO S.p.A. (Italy) in a trademark infringement case. According to the provisions of the Amicable Agreement, the infringer recognizes in full the non-property claims of FERRERO S.p.A. and agrees:

- not to use the Russian trademark No. 40729 and the international trademark registration No. 1073241 while importing into the territory of the Russian Federation, transporting and otherwise introducing confectionery products into the turnover;

- to liquidate at its own expense the goods marked by the Russian trademark No. 40729 and by the international trademark registration No. 1073241.

This case is of interest because at the petition of Sojuzpatent the court ruled on taking preliminary injunction measures of seizer the counterfeit goods. Therewith the court accepted Sojuzpatent’s lawsuit to consideration before the end of the period provided by the law for the obligatory extrajudicial dispute resolution procedure.
