The Moscow Arbitration Court ruled in favor of Sojuzpatent’s client FERRERO S.p.A. (Italy) obliging both infringers to stop violation of FERRERO S.p.A.’s rights for Russian trademarks No. 172654, No. 420210, No. 399626 consisting in the use of the designation "Tiki-Taki" when introducing into the turnover, including in the offer for sale, sale, advertising on the Internet and demonstration at the exhibitions of the sugar dragon "Tiki-Taki". The court withdrew from each of the infringers compensation in the amount of 100 000 RUR in favor of FERRERO S.p.A. The Ninth Arbitration Court of Appeal left the said Decision in force. One of the infringers disagreed with the judicial acts adopted by the first instance court and the appeal court and filed a cassation to the Court for Intellectual Property Rights. The cassation court ruled to return the cassation due to failure to pay the state fee for consideration of the cassation.
