Moscow Arbitration Court Rules in Favor of Sojuzpatent’s Clients – Public Stock Company “Veropharm” and LLC “LANS- Pharm”.

The Moscow Arbitration Court ruled in favor of Sojuzpatent’s client – Public Stock Company “Veropharm” and LLC “LANS- Pharm” in a patent RU 2134123 infringement case. The Court rejected the claims of patent holder to oblige JSC "Veropharm" to stop alleged violation of patent rights to the patent RU 2134123, including prohibition to propose for sale, sale and other introduction into circulation and storage for the said purposes of medicine "Tautax". The court also rejected the claims of patent holder to oblige LLC "LANS-Pharm” to stop alleged violation of patent rights to the patent RU 2134123, including the prohibition to manufacture, offer for sale, sale, other introduction into circulation and storage for the said purposes of medicine "Tautax" and to oblige LLC "LANS-Pharm” to recognize the rights of the plaintiff as the owner of the patent RU 2134123 when circulating medicine "Tautax". The decision of the Moscow Arbitration Court of April 7 2015 was taken as a result of a new consideration of the case since it had been sent back to the first instance court by previous Ruling of the Federal Arbitration Court of Moscow Region, which revoked the earlier Decision of the Moscow Arbitration Court of May 25, 2011 and the Ruling of the Ninth Arbitration Appeal Court of September 15, 2011.
