On May 7, 2022, Order No. 1532 of the Ministry of Industry and Trade of Russia dated April 19, 2022 came into force. The Order introduced the list of goods for parallel imports.
The document was adopted in accordance with Decree of the Government of the Russian Federation No. 506 dated March 29, 2022 and Federal Law No. 46-FZ dated March 8, 2022. The claims for the protection of intellectual rights in respect of the listed products are not to be applied to goods that were legally put into civil circulation outside the territory of the Russian Federation. Accordingly, civil liability is excluded for cases of importation of products by importers bypassing official distribution channels.
At the same time, all customs and other control procedures must be observed. When carrying out the necessary procedures, relevant state bodies will have to verify the codes for foreign-traded goods (TN VED) and designations of goods with the above-mentioned Order of the Ministry of Industry and Trade of Russia.
According to official clarifications, the purpose of adopting the document was to protect the interests of domestic consumers of the products of those foreign companies that left the Russian market under the sanction’s regime.
