Can an inventor waive the right to be mentioned in the publication?
The regulation of this issue in the Russian and Eurasian patent systems is similar to that of many other jurisdictions. Article 1385 of the Russian Civil Code allows an inventor to waive his or her right to be mentioned in the publication.
The standard patent application contains a respective checkbox, and we have a form to be filled in by those inventors who do not wish to be mentioned.
A similar provision is contained in Rule 8 of the Eurasian Patent Regulation: an inventor can file a request to not be mentioned in the publication (and file an application recalling such a request) before the technical preparation of the publication has been completed.
