When does the publication of a Russian or Eurasian patent application take place?
Under Russian law, the publication should take place 18 months after the day the patent application was filed with Rospatent. The publication date for PCT national phase applications is also calculated from the filing date, which is deemed to be the international filing date.
The 18-month term may be reduced on the applicant’s request submitted to Rospatent within 12 months of the date the application was filed.
Under the Eurasian Patent Convention, an application is to be published 18 months after the priority date. Accordingly, a PCT regional phase application (in most cases) will be published by the Eurasian Patent Office (EAPO) shortly after the documents have been filed with the EAPO.
