Sojuzpatent Takes Part in Session “Counteraction to the Production and Distribution of Counterfeit Products” in the Frames of XI International Forum “Intellectual Property – XXI Century”

Sojuzpatent’s Senior lawyer Maria A. Plotkina made a report “Problematic aspects of detection of counterfeit goods and protection of exclusive rights to a trademark while moving goods across the customs border” at the session “Counteraction to the production and distribution of counterfeit products” held in the frames of XI International Forum “Intellectual Property – XXI Century”.

Maria highlighted specific difficulties that the right holders face in the process of protecting trademark rights via customs legislation. Among them are problems connected with recordation of the trademarks into the customs register, difficulties with the detection of the counterfeit goods on the customs border, court resolutions on the issue of confiscation of the goods, problematic aspects in the identification of parallel imports, in particular in connection with the introduction of a mandatory pre-trial order of dispute settlement.

The Seminar gathered about 200 attendees, including representatives of the Ministry of Internal Affairs, Federal Customs Service, industrial and trade companies, lawyers and patent attorneys.
